The Regulatory Reform (Fire Safety) Order 2005

The Regulatory Reform (Fire Safety) Order 2005 is often referred to as the Fire Safety Order. The Order came into force on the 1st October 2006. It is designed to provide a minimum fire safety standard in all non domestic premises with a few exceptions. If it is a workplace it designates the employer the Responsible Person or quite often referred to as the RP.

If any other person has to some extent control over the premises, they could have duties under the Order. If it is not a workplace then any person having control to some extent, or the owner can be designated the RP. Those persons or a person acting on their behalf, are required to carry out fire safety duties which includes ensuring the general fire precautions (GFPs) are satisfactory and conducting a Fire Risk Assessment (FRA).

If more than five persons are employed, either within the premises or across all the business premises, if it is a chain, the Fire Risk Assessment has to be written, with the significant findings listed accordingly.

What is the Enforcement Management Model?

 

The Enforcement Management Model (EMM) is a logical system that helps inspectors to make enforcement decisions in line with the Health and Safety Executive’s (HSE’s) Enforcement Policy Statement (EPS). The EPS sets out the principles inspectors should apply when determining what enforcement action to take in response to breaches of health and safety legislation. Fundamental to this is the principle that enforcement action should be proportional to the health and safety risks and the seriousness of the breach.

Local Authority Fire Safety Inspecting Officers also follow the Enforcement Management Model when considering all aspects of any possible enforcement action.
